At this time we do not offer pre-order / backorder capability. In the future, we may offer you the ability to pre-order a product before it becomes available. If you choose to pre-order a product, we will not charge you until the product becomes available and we can complete your purchase.
4. Out-of-Stock Items
If the color, size or width of a product you would like to purchase is not shown in the relevant drop-down box or list of options on the product's information page, then the color, size or width is not available for purchase. In the event that the specific product that you would like to purchase is unavailable, please check our Services at a later time as our inventory of products is subject to change.
5. Shipping & Handling; Export
You agree to pay all shipping and handling charges shown to you at the time you place your order. We reserve the right to increase, decrease, add or eliminate these charges from time to time, and you agree to check all charges prior to placing an order. If for any reason you are not completely satisfied with your purchase from 1836 REPUBLIC WESTERN WEAR within the first thirty (30) days after delivery, we will provide a refund or credit or replace or exchange your product pursuant to our Returns and Exchanges Policy.

8. Limited Warranty
1836 REPUBLIC WESTERN WEAR warrants its products to be free of defects in workmanship and material for a period of 3 (three) months from the date of purchase. This limited warranty runs to and is valid only for the first purchaser. Variations of coloring or shading or other deviations caused by the inherent nature of using natural materials in the manufacturing process are not considered defects. Wear and fit issues are also not considered defects. 1836 REPUBLIC WESTERN WEAR has no liability for and this limited warranty does not cover improper sizing or fit once a product has been worn. We do not warrant soles against wear, nor will we consider a claim when a boot is altered, misused or abused in any way. Reasonable care is essential with all 1836 REPUBLIC WESTERN WEAR products. If you believe that your product has a manufacturer defect, please contact customer service as indicated in the Returns and Exchanges section above. This warranty gives you specific legal rights, and you may have other rights, which vary from state to state.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 1836 REPUBLIC WESTERN WEAR BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOSS OF BUSINESS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, NOR SHALL THE AGGREGATE LIABILITY OF 1836 REPUBLIC WESTERN WEAR, WHETHER IN CONTRACT OR WARRANTY, ARISING OUT OF OR RELATING TO THESE TERMS OR THE PURCHASE OR USE OF ANY PRODUCTS OR SERVICES PURCHASED THROUGH THE SERVICES EXCEED THE PURCHASE PRICE OF THE PRODUCT OR SERVICE. 11. Arbitration

You and 1836 REPUBLIC WESTERN WEAR agree that you will notify each other of any dispute within thirty (30) days of when it arises, that any arbitration will occur in Houston, Texas, and that arbitration will be conducted confidentially by a single arbitrator in accordance with the Rules of the American Arbitration Association. You and 1836 REPUBLIC WESTERN WEAR also agree that the state or federal courts in Houston, Texas have exclusive jurisdiction over any appeals of an arbitration award and over any suit between the parties not subject to arbitration. Other than class procedures and remedies excluded herein, the arbitrator has the authority to grant any remedy that would otherwise be available in court. Any dispute between the parties will be governed by the laws of the State of Texas and applicable United States law, without giving effect to any conflict of laws principles. Whether the dispute is heard in arbitration or in court, you and 1836 REPUBLIC WESTERN WEAR will not commence against the other a class action, class arbitration or other representative action or proceeding.

If any provision of these Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
